Judicial Manoeuvring for Social Justice: A Comment on Davinder Singh v. State of Punjab

The Supreme Court’s recent decision in Davinder Singh v. State of Punjab , has permitted subclassification among the Scheduled Castes, paving the way to the creation of a ‘creamy layer’ exception among the Scheduled Castes as notified under Article 341. The present paper critically analyses the judgement, and discusses the implications which can flow from such an important socio-political stance.
